Consistency Updates Index
Air pollution from Outer Continental Shelf (OCS) activities is regulated under Section 328 of the Clean Air Act (CAA) and the corresponding OCS Air Regulations at 40 CFR Part 55.
For OCS sources located within 25 miles of the seaward boundary of States along the Pacific, Arctic and Atlantic Coasts (other than OCS sources located offshore of the North Slope Borough of the State of Alaska), and along the United States Gulf Coast off the State of Florida eastward of longitude 87 degrees and 30 minutes, the regulatory requirements shall be the same as would be applicable if the OCS source were located in the corresponding onshore area.
These requirements include, but are not limited to, State and local requirements for emission controls, emission limitations, offsets, permitting, monitoring, testing, and reporting. This includes requirements to attain and maintain Federal and State ambient air quality standards and prevent significant deterioration of air quality.
The EPA Administrator is required to update such requirements as necessary to maintain consistency with onshore regulations in what is commonly known as a consistency update. Consistency updates follow the EPA regulations at 40 CFR 55.12 and any regulations incorporated by reference into OCS air regulations at 40 CFR Part 55 are specifically included in 40 CFR 55.14 and Appendix A to Part 55.
