This memo responds to the request for a deviation from 40 CFR 35.3520(e)(1), which prohibits DWSRF financing of dams and dam rehabilitation. This deviation would allow the state of Virginia to use DWSRF financing for the Beaver Creek Dam Rehabilitation Project to meet the current drinking water and public health needs of Martinsville, Virginia
