Summary

Facility was not in compliance with its No Exposure Certification. Certain drums and bins with cleaning chemicals were stored outside not undercover or within a storm-resistant shelter and were not sealed. Some of these drums and bins had evidence of spills around them. EPA is alleging that Lakeview Marine, Inc. has violated Section 301(a) of the CWA, 33 U.S.C. § 1311(a), by discharging stormwater without having obtained authorization under the Multi-Sector General Permit for Stormwater Discharges Associated with Industrial Activities MSGP, or any other National Pollutant Discharge Elimination System ("NPDES") permit.
