Public Notice: Final Decision; Class VI Underground Injection Control Permits for Carbon TerraVault JV Storage Company Sub 1 LLC, Elk Hills Oil Field, Elk Hills, CA

Summary

In accordance with the requirements of the Code of Federal Regulations (C.F.R.), Title 40, § 124.15, the United States Environmental Protection Agency, Region 9 (EPA), is issuing four Class VI Underground Injection Control (UIC) Permits, R9UIC-CA6-FY22-1.1, R9UIC-CA6-FY22-1.2, R9UIC-CA6-FY22-1.3, and R9UIC-CA6-FY22-1.4, to Carbon TerraVault JV Storage Company Sub 1, LLC (CTV). EPA is also issuing the Response to Comments (RTC) document, pursuant to 40 C.F.R. § 124.17. The RTC document specifies the provisions of the draft permit that have changed in the final permit decision and responds to all significant comments received by EPA during the public comment period or during the public hearing.

The final UIC permits, EPA’s RTC document, and a copy of this notice are available via EPA’s UIC permit web page. These documents are also available online at www.regulations.gov under docket number EPA-R09-OW-2023-0623.

Public Comments

EPA opened the public notice period for the draft UIC permits on December 20, 2023. The public comment period ended on March 20, 2024. EPA held a public hearing during the public comment period for the draft permits on February 28, 2024. EPA provided a subsequent opportunity for the public to provide written comments on revisions to the draft permits from July 12, 2024, through August 12, 2024. The final permit decision will be effective on February 3, 2025, in accordance with 40 C.F.R. § 124.15(b)(1), unless review is requested on the permit under 40 C.F.R. § 124.19.

Permit Appeal

Any person who filed comment on the draft permits or participated in the February 28, 2024, public hearing may petition the Environmental Appeals Board (EAB) to review any condition of the permit decision under 40 C.F.R. § 124.19(a) within 30 days after service of this notice of EPA’s final permit decision. Additionally, any person who failed to file comments or failed to participate in the public hearing on the draft permits may petition for administrative review of any permit conditions set forth in the final permit decision, but only to the extent that those final permit conditions reflect changes from the proposed draft permit.

Effective Date
