Approval to Dispose of Less than 50 ppm PCB Remediation Waste Issued to USWAG Members
On February 12, 2020, EPA renewed the final disposal approvals to USWAG members. The approvals allow the disposal of less than 50 parts per million (ppm) PCB Remediation Waste under the Toxic Substances Control Act (TSCA) in certain non-TSCA approved disposal facilities, such as municipal solid waste landfills, non-hazardous waste landfills, and hazardous waste landfills. EPA granted the original approvals to USWAG member companies on June 14, 2014, and April 12, 2016. These approvals expired June 14, 2019, and were administratively continued pending renewal.
On July 29, 2019, EPA posted draft approvals for public comment. EPA received comments that led to revision of Condition 1 of the approvals. EPA posted a new version of the draft approvals for an additional 30-day public comment period starting December 9, 2019. The members listed in Appendix II of the draft approvals expanded to include both parent and operating companies. Upon closing the public comment period on January 7, 2020, one set of comments was received, and it was supportive of the approvals. EPA finalized the approvals with no substantive changes to their content. The final approvals posted here maintain the same permissions to all listed USWAG member companies.
2022 New Member Update
USWAG submitted a request to EPA in September 2022 to add one new USWAG member to the existing risk-based disposal approvals issued to USWAG. EPA is issuing final approvals, containing minor changes to the approvals issued in 2020, with the same expiration date as the 2020 approvals and an appendix that includes the new member. The new member is Pacific Gas and Electric Company.
EPA issued draft approvals on October 31, 2022 and accepted public comments through November 30, 2022. EPA received one supportive comment on the draft approvals. The final approvals are unchanged from the draft approvals issued for public comment, and contain the following minor changes to the terms of the approvals issued to USWAG members in 2020:
- Updated contact information for the Office of Resource Conservation and Recovery and Regional PCB Coordinators.
- Updated language describing allowable waste analysis methods in condition eight (8).

2021 New Member Update
USWAG submitted to EPA an updated list of members that includes new members in September 2021. EPA is issuing final approvals containing the same terms as the approvals issued in 2020, with the same expiration date as the 2020 USWAG approvals and an appendix that includes the new members.
The new members are:
- AES Warrior Run, LLC
- Dayton Power and Light Company
- New Hampshire Electric Cooperative
EPA issued draft approvals on November 8, 2021 and accepted public comments through December 8, 2021. No comments were received, and no changes were made to the draft approvals. The final approvals can be found below.
Approval to Dispose of Less than 50 ppm PCB Remediation Waste Issued to American Public Power Association Members
On April 12, 2023, EPA renewed the final disposal approvals to American Public Power Association (APPA) members. The approvals allow the disposal of less than 50 parts per million PCB Remediation Waste under the Toxic Substances Control Act in certain non-TSCA approved disposal facilities, such as municipal solid waste landfills, non-hazardous waste landfills, and hazardous waste landfills. EPA granted the original approvals to APPA members on September 28, 2017, with subsequent approval modifications adding new members on June 15, 2018, and February 13, 2020. These approvals expired September 28, 2022, and were administratively continued pending renewal.
EPA issued draft approvals on February 6, 2023, and accepted public comments through March 8, 2023. EPA received one supportive comment on the draft approvals; the final approvals are unchanged from the draft approvals issued for public comment. The final approvals are linked below.
